These Terms and Conditions ("Terms") govern your access to and use of our Website, including browsing, purchasing artworks, and interacting with our services. By accessing or using this Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Purchasing Artworks 

• By purchasing artwork from Jane Hubbard Art via this Website, you (“Buyer”) agree to be bound by these Terms. These Terms prevail over any other documentation or communication.

1.1 Product information 

• We make every effort to ensure accurate descriptions of artworks, including artist details, images, medium, dimensions, and pricing. However, we do not guarantee the accuracy of all information. 

• Original artwork is handmade and unique, therefore may show slight variations, texture, and colour. 

• Printed artworks may have slight variations and colours may vary slightly depending on screen settings. 

1.2 Pricing 

• Prices are in UK Sterling and include VAT and UK shipping, unless specified otherwise.

• Prices are subject to change without notice.

1.3 Order Process

• By placing an order, you offer to purchase the artwork. We reserve the right to accept or reject orders at our discretion (e.g. due to availability or pricing errors).

• You agree to double-check artwork specifications meet your expectations before placing an order. Please ensure all delivery details are correct at the time of ordering. We are not responsible for delays caused by couriers, but we will assist where possible in resolving delivery issues.

• Payments are processed securely via third-party providers (e.g. PayPal, Stripe). You agree to provide valid payment information and authorise charges for your order.

• Order Confirmation: Upon successful payment, you will receive an order confirmation via email. This does not guarantee artwork availability until shipment is confirmed.

1.4 Shipping

• Payment is required in full before dispatch.

• We offer free UK shipping on all orders unless otherwise stated.

• International shipping is available on request, as this will vary according to insurance and import taxes for each country.  Please contact us for a delivery quote and timescales.  

• Shipping times and costs (if applicable) will be provided at checkout, but typical UK delivery is within 5-7 working days. 

• Orders are sent via a tracked and insured courier service.

• The Buyer agrees to inspect artworks upon receipt and report any concerns or damages by email within 48 hours to janehubbard1@me.com

• Responsibility for the artwork transfers to you once the item has been delivered to and receive at the address provided.
   

2. Returns and Refunds

2.1 We offer a 14-Day Returns Policy: 

 

• If, for any reason, you are not satisfied with your purchase, please contact us to organise a return.  Do not return your purchased artwork until return instructions have been given.

• Returns must be sent within 14 days of delivery, via tracked delivery. 

• To be eligible for a return, returns must be in original condition and packaging or packaged securely according to agreed instructions. 

• Return shipping costs are the Buyers responsibility (unless the artwork is damaged or incorrectly sent by us) and must be sent via a tracked and insured service. 

• Returned artwork remains your responsibility until it is received by the us. 

• Refunds will be processed within 14 days of receipt of the return (minus the shipping costs which remain payable by you)

• Commissioned or personalised artworks are non-refundable and cannot be returned, unless they arrive damaged or faulty.

2.2 Lost or damaged artwork 

• If your artwork is lost in transit or arrives damaged, please contact us within 48 hours with photographs of the damage and packaging.  

• We are not responsible for delays caused by the courier; however, we will assist in resolving any issues where possible.
   

3. Certificate of Authenticity

Every artwork comes with a certificate guaranteeing its authenticity and provenance. Contact us by email if you do not receive this with your purchase.

 

4. Intellectual Property

4.1 Website Content

• All content on the Website, including text, images, logos, and design is owned by or licensed to Jane Hubbard Art. You may not reproduce, distribute, or modify this content without prior written permission.

4.2 Ownership of the Artwork Copyright 

• Purchasing an artwork grants ownership of the physical piece only, but not to its intellectual property rights. 

• You have permission to display the Art for private use only. 

• Jane Hubbard Art retains all copyright and intellectual property rights, even after sale. 

• You may not reproduce, create derivative works, distribute, or use the artwork for commercial purposes without the artists prior permission in writing.

• Breaching of your obligations under section 4 and any copyright may result in legal action.

 

5. Data Protection

We process your personal data in accordance with applicable UK data protection laws.  We collect and store personal information necessary to process your order.

Your information will only be used for:

• order fulfilment 

• communication regarding your purchase 

We do not share your personal data with third parties for marketing purposes.

6. Governing Law and Jurisdiction 

These Terms and Conditions shall be governed by and construed in accordance with UK law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the UK courts.
